AACE Calgary-Chinook Section: Creating and Defending a Construction Claim

Do you suffer from delays, cost overruns, and contract violations? are you in the process of creating or defending a Construction Claim?

 

To create a claim, you must provide evidence of the issues and their impact on the project. To defend a claim, you must provide evidence and arguments to refute the issues and demonstrate that you have fulfilled your obligations under the contract.

The presentation will include a discussion on the following elements which make up a robust construction claim:

  • Notice,
  • Entitlement,
  • Cause and Effect analysis, including delay and lost productivity analyses,
  • Quantification, and
  • A discussion of advantages and disadvantages of various dispute resolution processes.

Eng. is a graduate of the University of Calgary with over 25 years of experience producing and evaluating construction claims for negotiation, mediation, arbitration, and litigation on commercial, large-scale residential, infrastructure, institutional, and industrial projects in Canada, the United States, the Middle East, and Asia. Michelle has worked with contractors, owners, government agencies, and non-profit agencies.

Michelle has been qualified as a testifying expert for construction claims. Michelle has also functioned as a third-party neutral, expert evaluator in construction disputes, and assisted in the evaluation and completion of troubled projects.
