About the presentation:

The contract adjudicator role is frequently misunderstood, resulting in it being improperly performed and presenting risks to client, consultant and the success of the project. This is an industry wide problem for which awareness and improvement is needed.

At the operational level, failure to properly engage with the contract adjudicator is an all too common reason for the improper administration of construction claims and their escalation into contentious disputes. Improper engagement includes:

  • Failing to follow the contract
  • Failing to supply the requisite information to support a claim
  • Not seeking appropriate remedies promptly as the causing event occurs
  • Owners failing /refusing/procrastinating in awarding remedies that are due

Following the contract and getting a prompt decision is essential to project success by keeping the job moving. Most importantly, it puts both sides in the best possible position in the event a dispute arises.

This presentation will encourage parties to proactively and properly engage with the contract adjudicator.


About the speaker: 

Ian Cartwright is a Commercial Director with Turner & Townsend, based in Toronto. He is a highly experienced engineering and construction professional with 35 years’ experience. For twenty years he has specialized in contract management, risk management and construction dispute resolution. Ian is fully experienced in dispute resolution having served as an expert witness, adjudicator and arbitrator.
