Loss of productivity is among the most complex and contentious issues in construction claims and dispute resolution. Labor productivity is typically measured as the ratio of input (e.g., labor hours) to output (e.g., installed quantities), yet productivity losses are often difficult to identify and quantify contemporaneously. Productivity can be affected by numerous factors throughout the course of construction. Some factors may be attributable to the owner, such as design changes, differing site conditions, or directed acceleration, while others fall within the contractor's control. This session examines loss of productivity claims through the three fundamental elements of construction claims: entitlement, causation, and damages quantification. Using real-world case studies, it will discuss common analytical methodologies, practical challenges, and approaches to resolving productivity disputes, while highlighting key lessons learned and best practices. Understanding the nature of loss of productivity allows owners, designers, and contractors to better manage projects to avoid, mitigate, and resolve relevant disputes.
